Join Jenifer Hess and Ryan McIntyre, of Riemer Hess LLC, to learn about Schuyler v. Sun Life, a new decision from the Second Circuit Court of Appeals with significant implications for employment attorneys, particularly when dealing with general releases in severance agreements.
In Schuyler, the Court examined whether the broad release language in a severance agreement waived the claimant’s right to pursue her ERISA long term disability claim. The Court also discusses whether a waiver is “knowingly and voluntarily” made when the claimant was represented by counsel and the employer’s attorney stated the release would not affect her disability claim.
In a split decision, the Court ruled in favor of Schuyler. However, both the majority opinion and the dissent from Chief Judge Livingston have significant implications for employment attorneys.
