Come debrief with NELA/NY member Jason Solotaroff and co-counsel from Walden Macht about lessons learned from their recent jury verdict of $290,000 in emotional distress, $30,000 in economic damages and $5.9 million dollars in punitive damages. Filed in 2015, the case alleged discrimination and breach of contract claims on behalf of Denise Rubin, the former general counsel of the Napoli Bern, a mass tort law firm. After filing, Napoli Bern took a series of retaliatory actions against Ms. Rubin including a meritless and defamatory counterclaim, affirmative lawsuits as well as some efforts to stop other attorneys from working with her. Hear about how counsel navigated two summary judgment motions, two trips to the First Department and a two-year wait for a trial date after filing the Notice of Issue. Chat informally with the trial team over virtual lunch to ask questions and to address whether Manhattan Supreme juries are worth the wait; which causes of action succeed; why trial counsel and juries don’t always see eye-to-eye; and how to have fun in the bifurcated punitives phase of trial.
